These Terms of Service ("Terms") govern your access to and use of frothdenton.com (the "Site") and any related services provided by Froth Coffee & Dessert Bar Denton LLC ("Froth," "we," "us," or "our"). By using the Site you agree to these Terms. If you do not agree, do not use the Site.
1. Eligibility
You must be at least 13 years old to use the Site. Job applications submitted via the Careers page require you to be 18 or older.
2. Use of the Site
You agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms.
- Attempt to disrupt, attack, or reverse-engineer the Site or its underlying systems.
- Submit false, misleading, or fraudulent information through any form.
- Scrape, harvest, or collect data from the Site without our written consent.
- Infringe the intellectual property or privacy rights of Froth or others.
3. Forms and submissions
Information you submit through the Careers, Fundraising, or contact forms is subject to our Privacy Policy. We may decline to process any submission at our discretion. Submitting a form does not guarantee employment, an event date, or any other outcome.
4. Fundraising program
Fundraising events are governed by additional terms communicated when your event is scheduled, including the donation calculation (25% of qualifying net in-store sales tied to your event keyword), event windows, and Venmo payout timing. Froth reserves the right to cancel or reschedule events for operational reasons.
5. Online ordering
Online ordering is provided through the Froth ordering app, powered by a third-party platform. Orders placed through the app are subject to the order confirmation you receive at checkout. Pricing, availability, and pickup times are not guaranteed and may change.
6. Intellectual property
All content on the Site — including the Froth name, logo, photography, copy, graphics, and code — is owned by Froth or licensed to us and is protected by U.S. and international IP laws. You may not copy, reproduce, or distribute Site content without our written permission, except for personal, non-commercial use.
7. Third-party links and services
The Site may link to third-party sites and services (Google Maps, Instagram, Facebook, our ordering app, etc.). We are not responsible for the content, policies, or practices of those third parties.
8. Disclaimers
The Site is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
9. Limitation of liability
To the maximum extent permitted by law, Froth and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site. Our total liability for any claim related to the Site will not exceed USD $100.
10. Indemnification
You agree to indemnify and hold Froth harmless from any claims, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Site or violation of these Terms.
11. Governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Exclusive venue for any dispute is in the state or federal courts located in Denton County, Texas.
12. Changes
We may update these Terms at any time. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
